El Govern del PSOE i d’Unidas Podemos indulten l’espoli de la jerarquia de l’Església

Dels últims 170 anys, durant 154 anys els béns de culte (catedrals, esglésies, ermites, capelles, oratoris i santuaris) no es van poder immatricular ni registrar al Registre de la Propietat Privada perquè ho prohibia la Llei Hipotecaria del 1861, el Decret Hipotecari franquista del 1946 i el seu Reglament del 1947, ja que es consideraven béns que no podien ser privats ni objecte de comerç ja que són béns comuns, col·lectius i comunitaris dels pobles.

Els 17 anys que no va ser així s’expliquen perquè el 1998 el Partit Popular (amb Govern de José María Aznar) va modificar la llei (sense l’objecció del PSOE, sigui dit). Així fins al 2015, l’Església va immatricular i registrar béns il·legalment, a través de normes preconstitucionals, i va traspassar els béns de domini públic a entitats privades (bisbats) provocant un dels escàndols immobiliaris més grans del món (la Conferència Episcopal reconeix 40.000 immatriculacions en aquet període!).

La responsabilitat de les immatriculacions no és només de la jerarquia de l’Església sinó també de tots els poders públics de l’Estat: l’executiu, el legislatiu i el judicial; tots van permetre la utilització d’unes normatives franquistes i anticonstitucionals fins al 2015.

La Constitució del 1978 va proclamar la llibertat de culte, els no privilegis a cap religió i l’Estat aconfessional, i, en la disposició derogatòria disposa la preeminència del text constitucional sobre les lleis anteriors. Tot i així, l’Església va continuar utilitzant els privilegis regulats per la Dictadura i va seguir immatriculant durant 38 anys de democràcia, actuant com a administració publica, com a autoritat pública i, els bisbes, com a fedataris públics (notaris) autocertificant i inscrivint béns al Registre de la Propietat Privada sense informació pública, ni cap títol de domini públic ni documents probatoris fins al 2015.  Per això el Tribunal d’Estrasburg, el 2014, va sentenciar que les immatriculacions eren un procés arbitrari que vulneraven la Constitució Espanyola i els valors comuns del Dret Europeu i que eren violacions continuades i massives dels drets garantits per la Convenció europea dels drets humans.

I el Govern “més progressista” de la història d’Espanya, què ha fet? Doncs, després de moltes promeses, el govern del PSOE va publicar el 16 de febrer passat el llistat elaborat pel govern del Partit Popular fa quasi cinc anys sobre les immatriculacions del 1998 al 2015: un llistat vell, incomplert, on falten les immatriculacions de 1947 al 1998, i que no compta amb les notes simples dels Registres de la Propietat que hem demanat amb reiteració (tampoc ho ha fet el Govern de la Generalitat), que són importants perquè detallen el conjunt de béns dels quals es van apropiar.

Per altra banda, contràriament al compromís de Pedro Sánchez en el discurs d’investidura de fer modificacions legislatives per revertir les immatriculacions de l’Església, ara el govern del PSOE-Unidas Podemos se’n renta les mans i deixa a l’administració local i als particulars las reclamacions per via judicial. Per tant, el Govern “més progressista” de la història incompleix els compromisos electorals i de govern i indulta l’espoli de la jerarquia de l’Església.

Des d’Unió de Pagesos i l’Associació de Micropobles de Catalunya continuarem treballant contra aquesta injustícia i proposarem al Parlament de Catalunya que insti el Govern de l’Estat a  remetre al Parlament les notes simples dels Registres de la Propietat de totes les immatriculacions de Catalunya; a ordenar la cancel·lació per nul·litat de totes les immatriculacions posteriors a la promulgació de la Constitució per inconstitucionalitat sobrevinguda, i a habilitar els mecanismes per qualificar el nostre patrimoni cultural i religiós de domini públic.

De nou, fem un crida a l’Associació Catalana de Municipis i a la Federació de Municipis perquè s’impliquin i defensin els patrimonis històrics i culturals del pobles de Catalunya.
